ST. PETERSBURG, Fla., September 17, 2021 (GLOBE NEWSWIRE) – Battaglia, Ross, Dicus & McQuaid, PA announces significant verdict of $ 3.1 million obtained by Howard P. Ross, ESQ., BCS this week against the city of St. Petersburg. This case concerned the development rights to a large commercial property in Midtown St. Petersburg that TLM Investment Group I, LLC had leased. Commercial property was intended for the creation of businesses that could have provided important jobs and services to underserved citizens of St. Petersburg. After TLM began the âinitial constructionâ, the city administration decided that this construction was not sufficient and terminated the lease and initiated legal proceedings to remove TLM from commercial property. This is after the TLM has invested significant sums of time and money in the redevelopment of the plot. TLM filed a counterclaim against the city of St. Petersburg, alleging unfair treatment and improper termination of a lease. In a first decision in April 2020, the judge agreed with TLM that the “initial construction” had started on time and the case proceeded to the determination of the damages suffered by TLM by the actions of the municipal administration.
In a ruling this week, Pinellas County Circuit Judge Lorraine Kelly, acting in circuit capacity, ordered the city of St. Petersburg to pay TLM Investment Group I, LLC $ 3,095,920 plus interest for damages resulting from the termination of the commercial lease contract. This amount reflected the lost profits as determined by expert witnesses and the Court that were suffered because the lease was terminated and TLM was not allowed to complete the development.
âWe were proud to be a part of this great victory for African American small businesses in St. Petersburg. It is a shame that the city administration chose to stop this project and prevent TLM from completing the project as TLM wanted, âcommented Howard P. Ross, ESQ., BCS
