National Unit Says Underlying Lawsuit Is Single Claim


By Ben Zigterman (May 4, 2022, 9:05 p.m. EDT) – A Nationwide insurance unit has asked a federal judge in Colorado to rule that it can treat two underlying lawsuits against a law firm as one complaint.

In its motion for summary judgment on Tuesday, Freedom Specialty Insurance Co. said its professional liability policy with The Conundrum Group LLP included broad language about what qualifies as a single claim.

The insurer argued that both cases involve the alleged participation of Benjamin Kahn and his Colorado law firm in the same scheme with a man named Gary Dragul.
